Scene from a car accident with two vehicles

I Was Injured in a Rideshare Service Vehicle - Now What?

People choose to use a rideshare service with the thought that they’re taking the safe option to get to their destination. Accidents still happen, though.

Which Insurance Company Covers Damages?

Many might assume that the insurance for the rideshare company itself would cover any damages. However, that’s usually not the case.

If you were in a rideshare vehicle but the driver of another vehicle was at fault for the accident, then that other driver’s insurance would most likely cover the damages. If your rideshare driver was at fault for the accident, their insurance also would most likely not cover damages if the rideshare driver only has the minimum required coverage. However, suppose the rideshare driver has special provisions on their insurance that cover them while being a rideshare driver or a commercial insurance policy. In that case, the rideshare driver could be responsible for damages. Unfortunately, many rideshare drivers do not carry this extra coverage, though.

Thankfully, most rideshare companies carry liability insurance for situations like this. Additionally, rideshare services may also have uninsured or underinsured insurance coverage. This type of coverage only kicks in when it’s unclear who the at-fault driver is or the at-fault driver does not have insurance.

However, the rideshare service will most likely exhaust every other available coverage option with their rideshare driver before initiating their coverage.

Suing the Rideshare Company

If you feel you were not properly compensated after a rideshare service accident, you could file a lawsuit against the company. This is not an easy strategy, though. That’s because most rideshare drivers are considered independent contractors. That removes the liability the rideshare company could face in most cases. If you are considering this type of legal action, you don’t want to do it alone.
